Terms and conditions

1. DEFINITIONS

1.1. Mullaco Online is a department of Mullaco Dewsbury Supermarket, Slaithwaite Road, Dewsbury, West Yorkshire, WF12 0AA

1.2. "Customer" means the person, firm or company buying or agreeing to buy goods and services from Mullaco Online.

1.3. "Price Paid" means the price paid by the Customer for the Product excluding carriage and any credit surcharge. The Price Paid is stated on the Order Confirmation.

1.4. "Order Confirmation" means the acknowledgement of the Customer´s order sent to the Customer by Mullaco Online.

1.5. "Product" are items supplied to the Customer by Mullaco Online.

2. GENERAL

2.1. These Conditions shall supersede all earlier conditions of Mullaco Online.

2.2. These conditions shall take precedence over any conditions of the Customer and shall not be varied without the written consent of a director of Mullaco Online.

2.3. Goods will be delivered to the address given by you when placing your order and displayed during your order confirmation.

2.4. Please note that sometimes products may vary in terms of packaging.

2.5. Certain products may be out of stock and we will contact you to correct your order.

2.6. We make every effort to ensure that all the pricing on the website is accurate, but in the event of discrepancies occurring we will inform you as soon as possible and ask you to reconfirm your order - whilst giving you the option to cancel.

2.7. If you cancel the order within four hours after confirmation, then you will receive a full refund, any cancellation after the four hour period you will receive a refund of the goods, but delivery may still be charged.

3. PRICES AND ORDERING

3.1. Unless otherwise stated all prices are inclusive of value added tax and exclusive of delivery.

3.2. The price payable by the Customer will be the price current at the date of the order.

3.3. Reservation of Products does not constitute an order and is not binding on either party.

3.4. Orders are accepted by writing, Internet, telephone or fax. Orders are only binding when Mullaco Online accepts payment in full for the order and the customer receives payment confirmation in writing.

3.5. Acceptance of your order and the completion of the contract between you and us will take place on dispatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it.

3.6. Errors and omissions are accepted. Images are for illustrative purposes only and certain products may differ from images online.

3.7. Prices may differ from our off line stores Mullaco Supermarket and Minimarket.

3.8. All attempts are made to ensure all "Ingredients" are as specified by the manufacturers of the respective products, however due to the frequent changes Mullaco Online can't guarantee the accuracy of the ingredients provided in product descriptions.

4. ACKNOWLEDGEMENT OF ORDER

4.1. You will be sent a confirmation e-mail to the address that you have provided us with once you have placed your order.

4.2. The confirmation will display the products that you have ordered, the costs of these products including VAT, delivery charges and also the time you placed the order.

4.3. If for any reason we are unable to process your order or in the instance of any delays you will be contacted by a member of our customer service team.

4.4. By ordering from Mullaco Online you adhere to these terms and conditions. The terms and conditions are subject to change at any time and it is your responsibility to check these terms and conditions before placing an order with us.

5. DELIVERY

5.1. Any delivery date stated is only a warranty by Mullaco Online to use reasonable endeavours to deliver by that date. No liability will be accepted by Mullaco Online for failure to meet a stated delivery date.

5.2. Customers must make a claim for damage or loss of the goods in writing: -

5.2.1. If a Product is damaged, within 72 hours of delivery; and

5.2.2. If a Product has been lost or is short, within 48 hours of delivery. No claim for loss or damage will be allowed if the Customer claims outside the above time limit.

5.2.3. If a product arrives damaged then the customer must keep all the contents and original packaging until their claim is resolved. Please contact us via email or telephone. We may ask you to email us images of the goods.

5.2.4. The cost of delivery for returning goods is £15.00 and is not covered by Mullaco Online, it is on the customer to pay for the return delivery. Mullaco Online will not be able to refund the original delivery cost.

5.3. If payment is made by credit or debit card, delivery will be made to the statement address of the cardholder.

5.4. In the event than no one is present at the delivery address when products are delivered a courier will leave a card with a number. It is up to the customer to contact the courier and arrange collection.

5.5. If there is no response at the delivery address after three attempts the customer will be charged an additional £15.00.

6. LIMITATION OF LIABILITY

6.1. Mullaco Online shall not be liable for any financial consequential indirect or other losses suffered by the Customer or any third party whether such loss arises in contract or tort or in any other way.

7. UNCONTROLLABLE EVENTS AND DELAYS

7.1. In case of delays caused by circumstances beyond the control of Mullaco Online or its suppliers, Mullaco Online shall have the right to either suspend delivery or to cancel the contract without liability.

7.2. Examples of Uncontrollable Events are (by way of example and not limited to) strike, lockout, riot, revolution, war, epidemic, working difficulties, transportation difficulties, fire, and failure of suppliers or official regulations.

8. CUSTOMERS OBLIGATIONS

8.1. You are responsible for your own choice of Product and the suitability for any particular purpose. You must ensure that any Products are compatible.

8.2. Images are for illustration purposes only.

8.3. Specifications are correct as per manufacturer information.

8.4. You must provide reasonable courtesy information and co-operation to Mullaco Online.

9. MEDIA

9.1. 'Marketing Emails' refers to any promotional email communication. The information transmitted in these emails is intended only for the person(s) or entity to which it is addressed and may contain proprietary, confidential and/or privileged material. If you have received an email in error, please contact the sender. Although the emails and any attachments are believed to be free of any virus, it is the responsibility of the recipient to ensure that they are virus free and no responsibility is accepted by the sender for any loss or damage arising in any way from the receipt or use thereof. Errors and omissions are accepted. Images are used for illustrative purposes only. Prices valid for the indicated time period only.

9.2. We reserve the right to use any comments or feedback for promotional purposes.

10. MISCELLANEOUS

10.1. If any part of these Terms and Conditions are found to be invalid or unenforceable by a court the rest are unaffected.
